Profile committee recommends rejecting of raw sugar import tariff quota raising draft Law

VR Committee for Taxation and Customs Policy has recommended VR to reject draft Law on bringing changes into art. 1 of Ukrainian Law “About Establishing of Tariff Quota on Shipping into Ukraine of Cane Raw Sugar,” reported VR Information Administration Dec 01/08. It is to be reminded, this draft Law (registered in VR under ¹ 3301) stipulates that Ukrainian cane raw sugar import annual tariff quota should be raised to 263,900 MT in 2009 (in 2010 – to 267,800 MT). This draft Law has been elaborated by Ukrainian Government due to agreements reached by Ukraine/WTO within process of Ukraine/WTO joining negotiations and therefore Committee members admit Government should also elaborate necessary changes to Ukrainian Law “About External Economic Activity” which includes quotas determinations, – with these determinations to be added with “tariff quota” term. Committee members say “this measure will enable Government to apply this norm automatically due to Ukrainian obligations on international agreements.” Besides, Committee members expressed concern about Ukrainian sugar market conjuncture possible worsening in case of draft Law adoption. In part., Committee members made it known that, as to Ministry of Economics data, “cane raw sugar, in fact, hasn’t been brought into Ukraine under presently efficient 260,000 MT quota.” However, some VR people deputies declared that “refusal of this draft Law may result in negative reaction of those WTO member-countries which had insisted on establishing of this quota and therefore have right to launch appellate procedures within WTO frameworks.”
