Cabinet proposes to Rada to create Seeds Producers National Register

As to Cabinet draft Law ¹ 1110 “About Bringing Changes to Law of Ukraine ”About Seeds and Seeding Material” (registered in Parliament on Dec 4, 2007), Cabinet has offered to Verkhovna Rada to form Seeds/Seeding Material Producers National Register. Draft Law stipulates issuing of passports permitting seeds/seeding material production/sale; besides, draft Law demands compiling of Seeds/Seeding Material Producers National Register. As to draft Law, passports issuing and Seeds/Seeding Material Producers National Register keeping is to be performed by central body for agrarian policy (specially authorized by executive power) on payment basis. Passports issuance payment rates will be fixed by Cabinet up to suggestions of central body for agrarian policy (specially authorized by executive power); finances received from passports issuance payments will be directed to State budget. As to draft Law, decisions on passports issuance (or non-issuance) will be adopted by certifying commission within 1 month after economic entity having submitted application. Annulments of passports are to be motivated only with economic entity having violated license agreements/certification requirements. Besides, draft Law authors suggest to cancel presently efficient legislative norm stipulating central body for agrarian policy (specially authorized by executive power) being able to issue permissions for import of kinds of seeds not registered in Ukrainian Register of Kinds of Plants on condition if these seeds are intended for reproduction and subsequent shipping from Ukraine due to international agreements. Draft Law authors are convinced proposed changes adoption will contribute to Ukrainian agricultural products output growth, improve seeds/seeding material quality and reduce number of domestic plant breeding fraud seeds/seeding material. Issuance of seeds/seeding material passports to economic entities will enable plant varieties owners (as well as authors, i.e. plant breeders) to receive license fees/just remuneration for their intellectual property, what will eventually lead to Ukrainian plant breeding competitiveness growth.
