Yushchenko vetoed moratorium on sugar plants dismantling until 2010

President Viktor Yushchenko has vetoed/returned for VR repeated examination Law stipulating establishing of moratorium on dismantling/disjointing of sugar plants as integral assets complexes until 2010, reported President press-service.
As to press-service, Yushchenko is convinced some provisions of Law «About Imposing of Moratorium on Dismantling or Disjointing of Sugar Plants» contradict to constitutional principles of private property right protection. Thus, in part., art.1 of this Law stipulates sugar plants alienation banning until Jan 1, 2008.
As to this Law, «alienation» is to be understood as transfer of sugar plants ownership rights to other legal/natural persons executed due to agreements/court decisions, what, in Yushchenko opinion, is a rights restriction which contradicts to Ukrainian Civil Code property rights regulations that stipulate proprietor to own, use and manage its property up to his choice, with State having no right to interfere within these rights execution.
Besides, as to President, Law provision on Cabinet elaboration of Sugar Plants Restructuring Complex Program without this Program being coordinated with sugar plants owners is as well infringement of current Ukrainian legislation.
